Final
Water Commission Public Hearing
In
2003, the State Water Commission took over control of
the `Ïao aquifer – Maui’s main drinking
water source – because it was degraded after years
of over-pumping and lack of recharge due to massive stream
diversions operated by Wailuku Water Company (formerly
Wailuku Agribusiness). On Thursday, February 2, the Water
Commission is considering giving HC&S, Wailuku Water
Company, and Maui County permits to continue taking water
that would otherwise flow in our streams. EarthJustice
needs your help to protect this resource for future generations.
Save the date, share your mana'o…
FINAL
WATER COMMISSION PUBLIC HEARING
Thursday, February 2, 2006
`Ïao Water Use Permit Applications
WHO: State Water Commission –reviewing applications
for “high-level” sources in `Ïao
WHAT: Final Public Hearing on HC&S’s, Wailuku
Water Company’s, and MDWS’s eight (8) applications
for wells or tunnels that intercept water that would otherwise
flow in our streams, especially `Ïao stream.
WHEN: 1:00 to 4:30 pm, Thursday, February 2, 2006
WHERE: State Office Building 3rd Floor, Conference Room
B (54 High Street, Wailuku)
WHY: Permit applicants must demonstrate their uses satisfy
the requirements of the law, including that:
• such uses are reasonable and beneficial &
in the public interest
• can be accommodated by the water source
• do not interfere with the rights and needs of
the Department of Hawaiian Home Lands.
HOW: Written testimony may be presented in-person at the
Commission meeting, emailed to Roy.Hardy@hawaii.gov (if
you email the Commission please bcc ksproat@earthjustice.org
), or faxed to (808) 587-0219. All testimony should be
addressed to the Commission on Water Resource Management,
and include the date, time, and subject matter.
WHY YOU:
You may be affected by the applications if you:
(1) use or would like to use water from the Central Maui
Service Area,
(2) use or would like to use water from `Ïao stream,
or would like to see water in that stream to support instream
uses such as native stream life and Native Hawaiian rights
and practices (including gathering and lo`i kalo).
(3) rely or used to rely on ground water from `Ïao
to support traditional and customary Native Hawaiian rights
or practices (e.g. used water from ground water springs,
or a spring fed your stream),
WHAT WE WANT:
• Increased efficiency rather than expanded pumping
demands
(i.e. reduce waste, use non potable water for non potable
functions)
• Increased stream flows to protect ‘Ïao’s
groundwater recharge & riparian, appurtenant, and
Native Hawaiian rights
• Increased development and use of alternative sources
of water
